I have a 2006 TJ with ABS and D44. And I have a brochure from Jeep stating
that with ABS a D44 is required, the brochure was printer in 10/2005.

However, I nearly killed myself one day, while failing to climbing a steep
slippery hill. I could climb 90% up, and then I could not complete the
climb. When I stuck, I hit the brakes to put reverse, but some glitch in
the ABS program had almost disabled the brakes, and the jeep went down the
slope in neutral and no brakes. Almost a free fall and very scaring
experience. I was lucky I didn't skid to the side, and there was a big flat
area at the bottom of the hill and didn't crush anywhere.
From that day I disable ABS everytime I go offroad by removing fuse 7 from
the fusebox behind the glove box.

So I take it you do not have the Trak Lok rear differential? In 2000, you
could order the 30" Tire/Wheel Group, which came with aluminum wheels and
30x9.5 Goodyear GSA's (Get Stuck Anywhere),and 3.73 final drive. It also
included the Dana 44, but if it was equipped with ABS the 35 was subsituted
because the 44 at that time was not available with ABS.
