I don't know. Kalyfornia has been using fresh air intakes since we
started SMOGging cars over forty years ago. My '78 Bronco:

road, unless I looked like a Mexican, whom can't afford insurance,
therefore: can not be harassed by the police. We be changing things

The square intake is not an emissions part. Only a real emissions **** would
try to force the issue on it. It's only purpose was, as Bill pointed out, to
function as a cold air intake. DC issued a bulletin many years ago
instructing dealers to remove it, which is why some have it, some don't.
The old YJ FAQ site had a retro fit deal where you could make a snorkel-type
intake tube out of plumbing PVC, That way you could extend the intake up to
the top of the inside of the hood skin if you felt you needed that much
relief. Mine kept popping off in rough terrain, and since there's not many
opportunities to get into deep water here I tossed it. I finally installed a
Turbo City intake, which does the same thing and reduced restriction as
well.
