Indeed, that's the heart of our legal mess. You can sue based upon any
plausible legal breach. Since you're not liable for the defendants costs you
can use the law to troll for a pre-trial settlement by making a complete
nuisance of yourself. Trial lawyers (you actually have a better word for
them, "Solicitors", which over here means a prostitute) have set up research
groups looking at various industries which would represent good targets for
lawsuits.

Using the precedents set by huge tobacco industry lawsuits the trial lawyers
latest is to sue McDonalds & other fast-food companies for selling
"unhealthy" food that makes people obese. The fact that obese people had to
1) buy the stuff repeatedly, 2) eat it, doesn't seem to matter. "Personal
responsibility" as defined by the rest of the world is simply an impediment
to legal settlements and has almost been completely written out of US law.

(Among other things I used to be responsible for Consumer Affairs at Jaguar
USA .... don't get me started!)

(Ok, now I rant!) Exactly, you now understand the entire American Tort
system. It's sort of a not-too-complex lottery, where truth is the first
casualty. It's an insidious system that's a form of rot, eating away at our
entire societal system, sort of like a snake eating it's own tail. It's well
understood by the people, but attempts at bringing the mess under control
are always stopped at the highest levels of Govt. Clinton repeatedly vetoed
every tort reform Bill put in front of him, naturally, because he's an
attorney himself and beholden to the trial lawyers. The most notable veto
of his Presidency in this regard was a Bill to adopt the UK system of
requiring the Plaintiff to absorb the Defendants costs in the event they
lost.

We now have a form of government that's best described as "Of the Lawyers,
By the Lawyers and For the Lawyers" Nearly every US Senator, especially on
the Democrat side, is a millionaire and is in some way an attorney or linked
in some way to the money-generating side of the legal system. They take
enormous sums of political contributions from the trial lawyers and their
lobbying groups. Naturally, they defend themselves by saying they're
defending the "little guy", but the entire system is a complete scam.

I would append this to read "Of the Lawyers & Insurance Companies,

Companies," because the insurance companies for the most part pay the
settlements on behalf of the insured, and then everyone pays through higher
premiums...

In the US attorneys even advertise, look in any phone book and you'll see full
page ads with catch phrases like "medical malpractice," "slip and fall,"
"personal injury," "get every dollar you deserve...", in Detroit, "Attorney Sam
Bernstein" has TV ads during the daytime talk shows.

My wife's brother-in-law is an attorney but he's dealt more with criminal
defense. His brother, however, is one of those who gives attorneys the bad
rap...he's one of those ambulance chasers who screws the insurance companies,
but if he loses a case and his clients can't pay his fees (no settlement to
take 40% of), he puts a lien on his client's house, etc.

They used to share an office and their practice until his brother had all
incoming calls to the office (i.e. new clients) forwarded to his house, so now
he's going to start his own practice.
